Terms of Service

These Terms of Service (hereinafter "Terms") govern the use of the belkafood.no website (hereinafter "the Platform"), operated by Tarasenko Multiservice, enkeltpersonforetak, registered in Norway, organisasjonsnummer 832237752 (hereinafter "the Administration").

By registering on the Platform or using it without registration, you confirm that you have read and agree to these Terms. If you do not agree, please do not use the Platform.

1. Terms and Definitions

Platform — the belkafood.no website and its mobile PWA version: a recipe builder and social network for authors in Russian, English, and Norwegian.

User — any individual aged 13 or older using the Platform.

Recipe — structured information about a dish, published by a User or obtained by the Platform from public sources: title, ingredients, cooking steps, photos/video.

2. Subject of the Agreement

The Administration grants the User access to the Platform's functionality: creating and publishing recipes, automatic calculation of nutrition and (in basic form) cost, scaling a recipe by portions or ingredient weight, following authors, favorites, ratings, and comments.

Some functionality (advanced cost and food-cost calculation, technical card export, your own purchase prices, importing a recipe by link, event planning, a personal author channel) is part of the paid Pro plan — its terms and price are published on the pricing page and may be updated by the Administration with notice to Users. The Pro plan also unlocks the builder's AI assistant and photo recognition — these features are paid separately from the subscription, through a prepaid AI balance. Payment for the Pro plan, the AI balance, the referral program with author payouts, and the author channel are described in sections 15–18 of these Terms.

3. Registration and Account

Some features (publishing recipes, following, favorites, comments) require registration — via email/password or via Google or Telegram.

The User must provide accurate information, keep it up to date, and keep their password confidential. All actions performed under a User's account are considered performed by that User personally.

4. User Rights and Obligations

The User has the right to: publish recipes; fork (copy for personal editing) published recipes by other authors, with attribution to the source; search and browse recipes; follow authors; leave ratings and comments; report a recipe; delete their account at any time.

The User must: comply with these Terms; act in good faith without infringing the rights of third parties; provide an accurate and non-misleading description of a recipe's ingredients and preparation method; not post prohibited content.

5. Prohibited Actions

Users are prohibited from:

• posting recipes or comments containing illegal or offensive content, or content that incites hatred or discrimination;
• posting knowingly false or misleading information about a dish's ingredients, allergens, or preparation method;
• gaining unauthorized access to other users' data or to the Platform itself;
• using automated scripts, scrapers, or bots to bulk-collect data from the Platform;
• sending spam through comments;
• uploading malicious software or taking actions aimed at disrupting the Platform's operation;
• creating multiple accounts to circumvent restrictions or bans.

6. User Content

Users independently create and bear full responsibility for the content of their recipes, comments, and other content. By posting a recipe, the User guarantees that they have the legal right to publish it, and that the description of its ingredients and preparation method is accurate.

By posting content, the User grants the Administration a simple, non-exclusive, royalty-free license to use it to the extent necessary for the Platform to function (display, indexing by search engines, caching, moderation, automatic translation into the Platform's other language versions).

The Administration may remove or restrict access to content that violates these Terms without prior notice, and may ask the author to revise a recipe, stating the reason.

7. Automated Content Processing

For the purposes of structuring, translation, and allergen detection, recipes may be automatically processed using artificial intelligence technologies (Google Gemini and fallback providers, including Anthropic Claude). See the Privacy Policy for details on such processing.

Separately, on the Pro plan a User may themselves initiate AI processing of their text, photos, and voice messages — via the builder's AI assistant and photo recognition (section 16). Such processing only ever starts from the User's own explicit action (opening the chat, uploading a photo, recording a voice message) and is paid for separately, as described in section 16.

Allergens and nutritional values are determined automatically from the ingredient list and are provided for reference only. If you have a food allergy or other dietary restriction, always check a recipe's ingredients yourself — the Administration does not guarantee the completeness or accuracy of automatically calculated allergen, calorie, or cost data.

8. Limitation of Liability

The Platform is provided "as is". The Administration does not guarantee uninterrupted or error-free operation of the Platform and is not liable for: the accuracy, safety, or quality of recipes posted by Users or obtained from public sources; the consequences of preparing or consuming dishes based on recipes from the Platform; the actions of third parties.

Recipes from public sources. Some recipes on the Platform are automatically aggregated from publicly available Telegram channels, and automatic translation into other languages may contain inaccuracies. The Administration is not liable for the accuracy, timeliness, or precision of such recipes.

9. Restriction and Termination of Access

The Administration may restrict or terminate a User's access to the Platform (including account suspension or recipe removal) in case of violation of these Terms, applicable law, receipt of substantiated complaints, or at the request of government authorities.

10. Personal Data

Processing of Users' personal data is carried out in accordance with the Privacy Policy, developed with regard to the General Data Protection Regulation (GDPR, EU Regulation 2016/679) and the Norwegian Personal Data Act (Personopplysningsloven).

11. Intellectual Property

The software code, design, logo, and the "Belka Food" name belong to the Administration. The User does not acquire any rights to the elements of the Platform, except for the right to use it under these Terms.

12. Account Deletion

Users may delete their account themselves in the profile settings or by contacting support at tavixno@gmail.com. See the Privacy Policy for details on data retention and deletion.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Norway. This does not deprive a User who is a consumer from an EU/EEA country of the right to protection under the mandatory rules of the law of their country of residence, where such rules provide broader protection and cannot be excluded by contract.

Disputes are resolved through negotiation. Claims should be sent to tavixno@gmail.com. If a dispute cannot be resolved through negotiation, it shall be referred to a competent court under the applicable law.

14. Final Provisions

The Administration may amend these Terms. The new version takes effect once published on the Platform. Continued use of the Platform after changes means acceptance of the new version. If any provision of these Terms is found invalid, the remaining provisions remain in effect.

15. Payment for the Pro Plan

The Pro plan is paid via a subscription with automatic monthly renewal. The subscription price is shown on the pricing page. Payment is processed by Stripe — the Administration does not receive or store your card data.

New users may be offered a free trial period (currently 15 days), available once per account. The User may cancel the subscription at any time via their account (subscription management) — access to Pro features remains until the end of the already-paid period, and no further charge is made. Refunds for an already-charged period are issued under the terms and procedures established by Stripe and applicable law.

The Administration may change the price of the Pro plan — a price change applies to subsequent subscription periods and does not affect payments already made.

16. AI Balance

Users with a Pro subscription have access to paid AI-based features — a conversation with the builder's AI assistant and recognizing a recipe from a photo. These features are paid separately from the Pro subscription, through a prepaid AI balance in Norwegian kroner.

The balance is topped up via the Stripe payment system — the Administration does not receive or store your card data. Charges are based on actual usage — the real cost of processing the request with the AI provider plus a Platform markup, not a fixed price per attempt. A charge is made for any response actually received from the AI provider, including cases where the request's content turned out to be unsuitable for creating a recipe — the request was still genuinely processed. No charge is made only in the case of a technical error, when no response is received from the AI provider at all.

Translating a recipe into other languages and voice input for the AI assistant do not consume the AI balance, but are protected from abuse by a usage frequency limit (no more than a few dozen requests per hour per user), set and adjustable by the Administration.

A topped-up AI balance does not expire. Refunds of an unused balance are issued under the terms and procedures established by Stripe and applicable law. The Administration may change AI balance pricing — a change applies to subsequent operations and does not affect charges already made.

17. Referral Program and Author Payouts

The Administration may admit individual authors to the referral program — automatically, once they reach threshold values published on the Platform (number of followers and published recipes), or on a case-by-case basis at the Administration's discretion.

A User with a Pro subscription may choose one "favorite author" among program participants and change this choice at any time on the pricing page or on the author's profile. While the User's subscription is active, a portion of its price (the amount is shown on the pricing page and may be changed by the Administration) is credited to the chosen author. If the User has not chosen an author, the full subscription price remains with the Administration.

Payout of accrued commission is made automatically via Stripe Connect once the author independently connects and confirms payouts through Stripe, including completing Stripe's own identity verification. The Administration does not participate in verifying an author's identity and does not guarantee payout availability for all countries — availability is determined solely by Stripe. Commission that has accrued but not yet been paid out remains credited to the author and is transferred to them as soon as technically possible after payouts are connected.

The Administration may suspend an author's participation in the program or refuse to accrue or pay out commission if it detects signs of manipulation, fraud, or other abuse of the program.

18. Author Channel

Users with a Pro subscription can create their own author channel — a feed of posts (text, up to 6 photos or one video up to 60 seconds per post) visible to other users for viewing, reactions, and comments.

Posts in an author channel are subject to the same content requirements and restrictions as recipes (sections 4–6 of these Terms). The Administration may moderate and remove channel posts on the same grounds as recipes.

Access to the channel is tied to an active Pro status: when the subscription ends, the channel becomes unavailable to readers, but its content is preserved and becomes available again if the subscription is renewed.
